2. Eligibility and use of our website
You may use our website only in accordance with these Terms and applicable law. You must provide accurate information when placing an order or contacting us.
If you are under the age required to enter into a binding contract in your jurisdiction, you should use the website and make purchases only with the involvement and permission of a parent or legal guardian, where required by law.
You must not use our website or its content:
- for any unlawful, fraudulent or misleading purpose;
- to infringe our intellectual property rights or the rights of another person;
- to upload or transmit viruses, malicious code or other harmful material;
- to interfere with the security, availability or proper operation of the website;
- to collect or misuse another person's personal information without lawful authority;
- to send spam, conduct phishing or engage in unauthorised scraping or automated data collection; or
- to impersonate another person or misrepresent your identity.
We may take reasonable steps to protect our website, customers and business where we reasonably believe these Terms have been breached or the website is being misused. Any suspension or restriction will be subject to applicable law and will not remove rights that have already accrued.
3. Products and product information
We make reasonable efforts to ensure that product descriptions, images, prices and other information on our website are accurate and up to date.
Product images and colours may appear differently depending on your device, screen settings and display. This does not affect any rights you may have if a product does not match its description or otherwise fails to meet a guarantee required by law.
We may update product information, introduce new products, discontinue products or change product availability from time to time. Changes to listings generally apply to future purchases and do not override an order we have already accepted, except where a change or cancellation is permitted by law or agreed with you.
If we discover a material error in a product listing or an issue affecting an order, we will take reasonable steps to address it in accordance with applicable law. We will not rely on an error clause to avoid obligations that the law requires us to meet.
4. Prices, currency and payment
Product prices and any applicable delivery charges will be displayed during the shopping and checkout process.
Before completing your order, please review the final price, currency, delivery charges and any other amounts shown at checkout.
The currency displayed or charged will depend on the website and checkout settings in effect at the time of purchase.
Payment must be made using the payment methods made available at checkout. Payments may be processed by third-party payment providers under their applicable terms and privacy practices.
You must be authorised to use the payment method you provide. We do not intentionally collect or store full payment card details where these are processed directly by an external payment provider; the actual handling of payment information depends on our payment configuration and is described further in our Privacy Policy.
We may correct genuine pricing or calculation errors and contact you if an error affects your order. If an order cannot be fulfilled because of a material error or another valid reason, we will explain the issue and arrange any cancellation and refund required by law.
We will not use this section to impose an undisclosed charge or change an accepted order price without a lawful basis.
5. Orders and order acceptance
When you place an order, you are submitting a request to purchase the products selected at checkout.
An order acknowledgement or confirmation email may confirm that we have received your order. The point at which an order becomes accepted and a binding contract is formed depends on our actual checkout and order-processing process.
We may need to decline, limit or cancel an order where there is a legitimate reason, such as suspected fraud, a payment issue, a product being unavailable, a delivery restriction or a material listing error. We will act in accordance with applicable law and communicate with you where reasonably practicable.
If we cancel an order after payment has been taken, we will arrange a refund for the cancelled products and any other amounts that must be refunded under applicable law. Refund timing may depend on the payment provider or financial institution.
We will not rely on this section to avoid responsibility for an order we are legally required to fulfil or to remove any rights you have under consumer law.
6. Shipping and Delivery
We offer shipping to the destinations available at checkout. Shipping options, delivery charges, free-shipping thresholds and estimated delivery times are described in our Shipping & Returns.
Orders placed before 4:45 pm NSW time are generally dispatched on the next business day. Delivery estimates are not guaranteed unless expressly stated otherwise.
For international orders, customs duties, import taxes and other charges may apply depending on the destination and the charges collected at checkout. Please refer to our Delivery Policy for further information.
We will take reasonable steps to fulfil orders and assist with delivery issues. Nothing in these Terms or our Delivery Policy excludes any obligations or remedies that apply under consumer law, including requirements concerning delivery within an agreed or reasonable time.
If your order is delayed, lost, damaged or returned to us, please contact hello@biancojuju.com so we can assess the circumstances and explain the available next steps.
7. Returns, Exchanges and Refunds
Our Returns & Refunds Policy explains how to request a change-of-mind return or exchange, including the seven-day request period and the conditions that apply to eligible products.
Change-of-mind returns are subject to the conditions set out in that policy. Different rights apply where a product is faulty, unsafe, not as described or otherwise fails to meet an applicable consumer guarantee or legal requirement.
Nothing in these Terms or our Returns & Refunds Policy excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded, restricted or modified under applicable law, including the Australian Consumer Law and New Zealand consumer protection laws.
To ask about a return or product issue, contact hello@biancojuju.com and include your order number and relevant details.
8. Promotions and Discount Offers
Promotions, discount codes and special offers may be subject to additional conditions, which will be made available with the relevant offer.
Any applicable eligibility requirements, exclusions, validity periods or usage limits should be clearly stated when the offer is presented.
We may withdraw or amend a promotion for future purchases where permitted by law. Changes will not affect rights already acquired in relation to an accepted order, except where the law permits otherwise.
All promotional and pricing claims will be subject to applicable consumer protection laws. We will not use this section to mislead customers about a discount, a product's usual price or the availability of an offer.
9. Intellectual Property
9.1 BIANCOJUJU Brand
The BIANCOJUJU name, brand identity, logos and other brand elements are valuable intellectual property. To the extent that rights are owned by or licensed to Mystic View Limited trading as BIANCOJUJU, those rights are protected by applicable intellectual property laws, including trade mark laws.
Where registered, the BIANCOJUJU trade marks are protected in the jurisdictions and for the goods and services covered by their registrations.
9.2 Website Content and Materials
Unless otherwise stated, the content on this website, including product photographs, images, text, graphics, website design and other original materials, is owned by BIANCOJUJU or used under licence from the relevant rights holder. You must not copy, reproduce, republish, distribute, commercially exploit or otherwise use these materials without prior written permission from the relevant rights holder, except where permitted by law.
9.3 Protected Product Designs and Intellectual Property
Certain products featured on or sold through this website may incorporate designs, inventions or other features protected by intellectual property rights, including registered designs, design patents, patents or copyright, as applicable.
Unauthorised copying, reproduction, manufacture, distribution or commercial sale of products or materials that infringe these rights may result in legal action by the relevant rights holder. BIANCOJUJU takes the protection of its brand and the intellectual property associated with its products seriously and reserves the right to take appropriate action where it has the legal right to do so.
Intellectual property rights may belong to BIANCOJUJU, its suppliers, manufacturers, designers or other rights holders. The existence, scope and ownership of any particular right depend on the relevant product and applicable law.
9.4 No unauthorised use or copying
You must not use the BIANCOJUJU name, logos, website content, product photographs or other protected materials in a way that infringes the rights of BIANCOJUJU or any other rights holder. You must not reproduce, distribute, sell or commercially exploit protected product designs or other intellectual property without the necessary permission or legal authorisation.
Nothing in this section limits any rights or exceptions available under applicable law.
10. Reviews, feedback and submissions
If you submit a review, comment, suggestion or other material to us, you are responsible for ensuring that it is lawful, accurate to the best of your knowledge and does not infringe another person's rights.
You must not submit material that is fraudulent, defamatory, abusive, discriminatory, unlawful, misleading or contains malicious code.
We may moderate, decline to publish or remove user-submitted material where we reasonably consider this appropriate, subject to applicable law and any rights that apply to the submission.
If you send us feedback or suggestions, you permit us to use them to consider and improve our products, website or services. This does not give us unrestricted permission to use your name, image, personal information or a review in advertising. Any marketing use of a customer's identifiable content must be handled in accordance with applicable law and any necessary permissions.
11. Third-party services and links
Our website may contain links to third-party websites or use third-party services, such as payment, analytics, delivery or other e-commerce tools.
Third-party services are generally provided by their respective operators and may be subject to separate terms and privacy policies. We encourage you to review those terms when using their services.
We are not responsible for the content or operation of third-party websites that we do not control. However, nothing in this section excludes any responsibility that BIANCOJUJU has under applicable law for products or services we supply, representations we make, or conduct for which we are legally responsible.
12. Privacy and personal information
Our handling of personal information is described in our Privacy Policy.
The Privacy Policy explains the categories of information we collect, how we use and disclose it, and the choices or rights available to individuals under applicable privacy law.
By using our website, you acknowledge that you have been given an opportunity to read the Privacy Policy. This statement does not replace any consent that may be legally required for a particular use of personal information, cookies or marketing activity.
13. Website availability and technical issues
We aim to keep our website available and functioning properly, but we cannot guarantee that it will always be uninterrupted, secure or free from errors.
From time to time, we may update, maintain, suspend or change parts of the website. Where reasonably practicable, we will take appropriate steps to minimise disruption.
We may correct website errors and technical issues as they arise. This does not remove our obligations in relation to orders already accepted or rights that customers have under applicable law.
14. Liability and consumer guarantees
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, statutory right, remedy or liability that cannot lawfully be excluded, restricted or modified under applicable law.
This includes any non-excludable rights that may apply under the New Zealand Consumer Guarantees Act 1993, the New Zealand Fair Trading Act 1986, the Australian Consumer Law or other applicable consumer protection legislation.
To the extent permitted by law, we are not responsible for losses caused by your unlawful use of the website, your breach of these Terms, or circumstances for which we are not legally responsible. This does not exclude liability where doing so would be unlawful, nor does it affect any rights you may have in relation to a product that fails to meet a consumer guarantee.
Where applicable law permits a limitation of liability, that limitation applies only to the extent permitted by that law and in the circumstances in which it is lawful to do so.
Nothing in this section is intended to create a blanket exclusion of responsibility for defective products, misleading statements, failure to deliver, or other conduct where the law provides a remedy.
15. Indemnity
You are responsible for losses, claims and reasonable costs to the extent they are directly caused by your unlawful conduct, your infringement of another person's rights, or your material breach of these Terms.
Any indemnity under this section applies only to the extent permitted by law, and does not apply to the extent a loss was caused by our own breach, negligence, unlawful conduct or other circumstances for which we are legally responsible.
Nothing in this section requires you to waive a consumer right that cannot lawfully be waived.
16. Suspension and Termination
You may stop using our website at any time.
Where we reasonably believe that a person has materially breached these Terms, used the website unlawfully, engaged in fraud or created a security risk, we may take proportionate steps to restrict or suspend access, to the extent permitted by law.
Ending or restricting access to the website does not automatically cancel an accepted order or remove any rights or obligations that arose before that time. Any cancellation, refund or other action affecting an order will be handled in accordance with applicable law.
17. Changes to these Terms
We may update these Terms from time to time by publishing a revised version on our website and changing the “Last updated” date.
The revised Terms apply from the date they are published, unless we state otherwise. A change will not retrospectively alter an existing order or affect rights already acquired, except where permitted by law or agreed with you.
We encourage you to review these Terms periodically. If a change requires your specific agreement under applicable law, we will seek that agreement where necessary.
18. Governing law and disputes
These Terms are governed by the laws of New Zealand, except to the extent that another law must apply.
If you are a consumer in Australia or another country, nothing in this section is intended to deprive you of any mandatory consumer protections available under the laws that apply to your purchase.
If you have a concern about an order or our services, please contact us first at hello@biancojuju.com so that we can try to resolve the issue.
Nothing in this section prevents you from exercising any right to bring a complaint or claim before a court, tribunal or consumer protection body where that right is available under applicable law.
19. General provisions
If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions continue to apply to the extent permitted by law.
If we do not enforce a provision on one occasion, this does not mean we waive the right to enforce it later.
These Terms and the policies expressly incorporated into them set out the terms applicable to your use of the website and purchases from us. They do not override any mandatory rights or obligations imposed by law.
You may not transfer your rights or obligations under these Terms where doing so would be unlawful or without any consent required by law. We may transfer or restructure our business arrangements only to the extent permitted by applicable law and without diminishing any non-excludable consumer rights.
